New controversy over the controversial Dunsborough Puma station was heard in the WA High Court



What must be the most controversial gas station in Australia is again before the court, with lawyers debating a new appeal at the Supreme Court of WA on Monday against last year's decision to approve South West development.

Stoush three years above a Puma station in downtown Dunsborough appeared to have been completed last year when the State Administrative Court decided to support the DCSC developers, even though the project was defeated twice by the Southern Joint Development Assessment Panel.

But SJDAP lawyers on Monday argued in the Court of Appeal there had been "legal error" in the Tribunal's decision, because it did not take into account changes to Busselton's City definition of "service station" in scheme planning, first made in 2015 but signed into law only the day before the 2017 verdict.

The verdict was submitted, but it was rejected earlier this year – a step that formed the basis of the latest appeal from SJDAP, which had requested a new SAT trial if it succeeded.
